A landmark legislation ensuring transparency and accountability in governance

Right to Information Act (RTI) 2005 is an act enacted by the Indian Parliament to ensure transparency and accountability in governance. This law grants every Indian citizen the complete right to access information held by public authorities.
Key Objectives
Ensure Transparency: Make the functioning of government systems transparent to the public.
Eradicate Corruption: Prevent corruption by enabling citizens to know administrative affairs.
Public Participation: Empower citizens further in the democratic process.
Accountability: Make government officials more accountable to the people.
Application and Time Limit
Whom to Apply?: Applications can be submitted to the Public Information Officers (PIO) of each office.
Fee Structure: The standard fee is Rs. 10. Persons Below Poverty Line (BPL) are completely exempted from the fee.
Time Limit for Reply: • Generally: Within 30 days
• Via Assistant PIO: Within 35 days
• Affecting life and liberty: Within 48 hours
Appellate Mechanisms

If information is not received or the received information is incorrect, an appeal can be filed:

First Appeal: Must be filed with the senior officer of the same office within 30 days after the expiry of the last date to reply or upon receiving the reply.
Second Appeal: If no relief is obtained in the first appeal, it can be filed with the State/Central Information Commission within 90 days.
Exempted Information (Section 8)

In the interest of national security, the following information is not obligated to be provided:

  • Matters affecting national security, sovereignty, and strategic interests.
  • Information explicitly forbidden by courts.
  • Information received in confidence from foreign governments.
  • Matters endangering the life or physical safety of individuals.
Penalties: The commission is empowered under this act to impose a penalty of Rs. 250 per day up to a maximum of Rs. 25,000 on an official who fails to provide information without valid reason or rejects an application.
